Public authorities are bound by public procurement law when procuring goods and services and carrying out public works. This law is largely regulated at European level and is further developed and implemented by the member states, in South Tyrol also by the Autonomous Province of Bolzano. The basic principles are transparency, equal treatment and competition. Depending on the contract value, simpler or very complex procedures are applied.

Legal protection is provided by the administrative courts, in the case of South Tyrol by the Autonomous Province of Bolzano; the Council of State in Rome is the appellate body; conflicts with Community law are settled before the European Court of Justice. When precautionary measures have been requested, the defence has to meet very close deadlines.
